There are 3 degrees of assault in Colorado:

First Degree Assault: (Class 3 or 5 Felony)

– If someone intentionally and permanently disfigures,  or disables an organ of another persons body

– Manifesting extreme indifference to human life and knowingly engages in conduct to create a grave risk of death to another person, therefor causes serious bodily injury to that other person

– If someone intentionally causes serious bodily injury to a peace officer, firefighter, emergency service provider, and threatens that person with a deadly weapon while knowing that person is currently engaged in the performance of their duties.

Heat of passion:

Possible Sentence: 2-6 years

Possible Fine: $1000 to 100,000

 

 

Second Degree Assault: (Class 4 or 6 Felony)

Possible Sentence: 4-12 years

Possible Fine: $2,000 to $500,000

– If someone intentionally causes bodily injury to another person with a deadly weapon

– If someone recklessly causes bodily injury to another person with a deadly weapon

– If someone intentionally causes bodily injury to any person while preventing a peace officer, firefighter, or emergency medical provider from preforming his or her duty.

– If someone intentionally causes physical or mental impairment, or injury to another person by a non consented drug or substance

C.R.S. 18-3-203

Heat of passion:

Possible Sentence: 15 months to 3 years

Possible Fine: $1000 to $100,000

 

 

Third Degree Assault: (Class 1 Misdemeanor)

Possible Sentence: 2 years

– If someone knowingly or recklessly causes bodily injury to another person or if a person acts criminally negligent and causes bodily injury with a deadly weapon to another person.

– Criminal Negligence could be an accident when you had possession of a deadly weapon and another person was injured
